If the Supreme Court introduces a party-based standard for gerrymandering, will this open up a series of lawsuits? Via Election Law BlogI use the electoral evidence to argue that no, it will act as more of a rebuttal towards future offenders.
Reason? As you can see in the chart, partisan gerrymanders only took off starting with the 2000 cycle of redistricting, at the same time people started to assume they were legitimate. Before that, they were significantly less common.
